Q: What is “Material Information” in property listings?
Material Information is the set of details that must be provided on every property listing so buyers can make an informed decision before making an offer. Past guidance divided this into three parts:
- Part A: Essential facts such as price, tenure, and council tax.
- Part B: Physical characteristics like utilities, broadband, and property construction.
- Part C: Location-specific or transaction-specific factors, such as flood risk or lease restrictions.
Failure to provide Material Information may be a compliance risk. The Competitions and Markets Authority (CMA) has made it clear that omitting upfront information can mislead consumers and lead to enforcement action.
